Wellness & Soul General trading conditions (Issue: March 2008)
1. Validity
The following General Trading Conditions are the basis for all contracts and also apply to all orders. Any General Trading Conditions of the orderer which may differ from our General Trading Conditions shall have no validity unless expressly agreed to by us.
2. Completion of contract
Your order represents an offer to us for the conclusion of a sales contract. When you place an order with Wellness & Soul, we will send you an order confirmation by e-mail confirming your order with us and containing the details thereof. This order confirmation does not indicate acceptance of your offer, but is only to inform you that we have received your order. A contract will only be established if we despatch the ordered goods to you.
3. Prices
All indicated product prices are given in EURO and include the applicable local VAT (excluding shipping costs).
4. Payment
We accept Master Card, VISA, Diners’ Club, American Express and JCB
- with Maestro (on ATM cards)
As well as credit cards, you can pay with your ATM card when placing orders in our Webshop.
5. Retention of title
We retain ownership of the goods until all payments due under the contract are received. We reserve the right to withdraw from the contract upon behaviour by the orderer which contravenes the contract.
6. Returns / complaints
The satisfaction of our clients is our highest priority. Should you nevertheless have a complaint about our products, please contact our Customer Service (service@wellnessandsoul.com).
Upon arrangement with our Customer Service, please return the unopened goods in their original packaging within 14 days together with a copy of the delivery note or the invoice to:

Please note that we cannot exchange or replace opened or used goods. Similarly, we cannot refund the cost for returning the goods.
7. Delivery / delivery costs
Wellness & Soul despatches orders to addresses anywhere in
Europe. We aim to complete all orders within 3-4 days of receipt. We despatch our goods with Austrian Post AG.
The costs of delivery are solely borne by the client. The effective despatch tariffs of Austrian Post AG shall apply in each case.
Deliveries outside of the EU may be subject to tariffs or import duties. Fees for duty-free gifts will be transferred to you.
8. Product liability
Demands for compensation in the sense of Article 12 of the Product Liability Law shall not be entertained, unless the compensation requestor can prove that the error was caused by us, or at the very least was caused by our gross negligence.
9. Law / Jurisdiction
Austrian law shall apply. The applicability of UN Purchasing Law is expressly denied. The contract language shall be German. The parties to the contract agree upon Austrian local jurisdiction. Except in the case of a consumer business, the responsible court in the town in which the business is based (District Court of St. Johann im Pongau) shall be exclusively locally responsible for adjudicating all disputes which may arise from this contract.
